General Terms and Conditions Max Markt BV

Article 1: Definitions.

- Offerings: Products that customers can order, purchase and pick up from the store through the site.

- Order: A customer selected selection of items from the range.

- Service Provider: Max Markt BV BE0891347549, with registered office at 2930 Brasschaat, Kasteellei 10.

- Agreement: The agreement between the customer and the store regarding the purchase of products for home delivery or pickup at the store.

- Store: An enterprise that prepares and sells meals, beverages and related items.

- Service: The commercial services and/or work offered by the service provider to the customer.

 

Article 2: Applicability

- These general conditions apply to orders placed by the customer and prepared by the store.

- By using the service, the customer agrees to these terms and conditions.

 

Article 3: Responsibilities of the Store

- The service provider provides an online platform where the offer is published and orders can be placed and processed.

- The customer pays on the website.

- The store is responsible for taking, preparing and preparing the order.

 

Article 4: Customer Obligations.

- The customer is required to provide accurate and complete contact and address information when placing an order.

- The customer must be present at the store at the appointed time to pick up the order.

- The customer must be home at the appointed time to receive the order. It is not possible to leave frozen or refrigerated products at the door.

- The customer must be available to the store, both by phone and email, from the time the order is placed until the time of home delivery or pickup at the store.

- The customer should contact the store prior to placing the order for questions about allergies and intolerances.

Article 5: Cancellation of the Agreement.

- The customer has the right to cancel or change the order up to 19 hours prior to the day of delivery.

- Max Markt BV reserves the right to cancel the agreement in certain circumstances, such as when products are not available, incorrect information has been provided by the customer, there are doubts about the correctness of the order, or in case of force majeure.

 

Article 6: Complaints

We strive to provide the best service to our customers. However, if you are not satisfied with our offer or agreement, we kindly ask you to report your complaint to Max Markt BV within 24 hours of receiving the goods or services. You can do this by sending an e-mail to shop@maxmarkt.be or by calling/messaging us at +32498979569. Please describe your complaint as fully and clearly as possible so that we are able to adequately address your complaint. We will do our best to address your complaint as quickly as possible and, if necessary, provide an appropriate solution. Your satisfaction is very important to us.

 

 

Article 7: Right of withdrawal

In accordance with Belgian law, the consumer has the right to withdraw from the contract within 14 days of receiving the goods or services, without giving reasons. However, this right of withdrawal does not apply to the delivery of perishable goods or goods that can spoil quickly. Given the nature of the goods we supply, these are excluded from the right of withdrawal. Article 10: Force majeure

In force majeure, situations in which external, unpredictable and unavoidable events prevent us from performing our services, we will not be liable for failure to perform our obligations. This includes, but is not limited to, natural disasters, wars, government actions, labor disputes, epidemics, pandemics, fires, technical failures and other situations reasonably beyond our control. In such cases, we will make every effort to contact the customer as soon as possible to explain the situation and, if possible, provide an alternative solution. However, due to the exceptional nature of such situations, we cannot guarantee that we will always be able to provide an alternative and we are not liable for any damage or loss caused by the inability to provide our services due to force majeure.

Article 11:Amendments to the General Conditions

We reserve the right to modify these terms and conditions at any time. Any amendment will take effect from the time the amended terms and conditions are published on our website. It is the customer's responsibility to regularly check the terms and conditions for changes. By continuing to use our services after publication of amended terms and conditions, the customer accepts these changes. If the customer does not agree to the amended terms and conditions, the customer has the right to stop using our services. It is the customer's responsibility to read the terms and conditions carefully before accepting them.

Article 12: Prices and Payment.

The prices of the products on our website include Belgian VAT. The total price of the order, including all costs, is displayed during the checkout process before the payment is completed. The order is confirmed from the moment the customer completes payment for the order on our webshop through our payment partner Mollie. We accept various payment methods offered by Mollie. If there are additional costs, for example due to additional shipping costs or other unforeseen costs, we will communicate this with the customer and discuss the method of payment or refund. It is the customer's responsibility to ensure that the payment details are entered correctly and that there is sufficient balance in the account to complete the payment.

Article 13: Liability

Max Markt BV shall not be liable for any indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for lost profits, goodwill, use, data or other intangible losses (even if Max Markt BV has been advised of the possibility of such damages) arising out of or in connection with the use of the service or products obtained through the service. In no event shall Max Markt BV's total liability to the customer, for any claims arising out of or related to the use of the service or products obtained through the service, exceed the total cost paid by the customer for the relevant products or services in the one-month period preceding the event giving rise to the claim. Max Markt BV is not liable for delays or failures in the performance of the contract due to force majeure, as defined in Article 10.

Article 14: Warranties and Conformity

Max Markt BV guarantees that the products and services delivered meet the usual requirements and standards that can reasonably be set at the time of delivery and for which they are intended when used normally in Belgium. The warranty as described above applies to items intended for use within Belgium. In case of use outside Belgium, the customer should himself verify if their use is suitable for use there and complies with the conditions imposed. Max Markt BV may in that case set other warranty and other conditions with respect to the goods to be delivered or activities to be performed. Any defects or incorrect products delivered must be reported to Max Markt BV within 24 hours of delivery. By mail to shop@maxmarkt.be. Max Markt BV is however never responsible for the final suitability of the products for each individual application by the customer, nor for any advice regarding the use or application of the products.
